Welcome to Bernard Labs. By accessing or using our website, mobile application, products, or services, you agree to be bound by the following Terms and Conditions. If you do not agree to these terms, please refrain from using our platform.
1. Acceptance of Terms
1.1. By using our services, you confirm that you are at least 18 years old or have parental/guardian consent to use our platform.
1.2. These Terms and Conditions form a legally binding agreement between you and Bernard Labs.
2. Services Provided
2.1. Bernard Labs provides AI-powered tools and solutions for home services professionals, including:
Real-time diagnostics and coaching for appliance and HVAC repair
Automated note-taking and documentation through voice, video, and photo capture
Parts sourcing and ordering assistance
Integration with Field Service Management (FSM) and Customer Relationship Management (CRM) systems
Fleet management and analytics tools for service businesses
Access to repair manuals, diagrams, videos, and technical forums
2.2. All features are subject to availability and may be updated, modified, or discontinued at our discretion.
2.3. Service levels and features vary by subscription tier (PRO, TEAM, COMMAND) as outlined in your selected plan.
3. User Responsibilities
3.1. You agree to use our services for lawful purposes only and in accordance with professional standards for home services work.
3.2. You are responsible for ensuring that your use of our platform complies with all applicable laws, regulations, and industry standards, including but not limited to EPA regulations, local licensing requirements, and safety codes.
3.3. Unauthorized use, such as reverse engineering, reselling, redistributing, or tampering with our AI systems, is strictly prohibited.
3.4. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.5. You acknowledge that Bernard Labs provides diagnostic assistance and coaching tools, but final repair decisions and professional judgment remain your responsibility as a licensed technician or service provider.
4. Privacy and Data Use
4.1. Your privacy is important to us. By using Bernard Labs, you agree to our Privacy Policy.
4.2. Data collected from your usage, including repair notes, diagnostic information, and usage patterns, may be used to improve our AI algorithms and enhance our services.
4.3. Personally identifiable information will never be shared without your consent, except as required by law or as necessary to provide services you've requested (such as parts ordering or FSM integration).
4.4. Audio, video, and photo content captured through Bernard Labs may be processed and stored to provide transcription, analysis, and coaching services.
4.5. Aggregated and anonymized data may be used for research, product improvement, and industry insights.
5. Intellectual Property
5.1. All content, designs, software, AI algorithms, and documentation provided by Bernard Labs are the intellectual property of Bernard Labs.
5.2. You may not duplicate, copy, distribute, reverse engineer, or exploit any part of our services without prior written consent.
5.3. You retain ownership of the repair notes, photos, and documentation you create using our platform, subject to our right to process this data as described in Section 4.
6. Limitation of Liability
6.1. Bernard Labs is provided "as is" without warranties of any kind, either express or implied.
6.2. We are not responsible for any losses, damages, or liabilities arising from the use of our services, including but not limited to repair outcomes, parts ordering errors, or business decisions made based on our platform.
6.3. While we strive for accuracy, our AI-generated diagnostics, coaching, and predictions are provided as assistance tools only and are not guaranteed to be error-free, complete, or appropriate for all situations.
6.4. You acknowledge that professional judgment and technical expertise are required for all repair work, and Bernard Labs does not replace proper training, licensing, or certification.
6.5. Our total liability for any claims arising from your use of Bernard Labs shall not exceed the amount you paid for the service in the twelve (12) months preceding the claim.
7. Subscription and Payment Terms
7.1. Subscription fees are based on your selected plan (PRO, TEAM, or COMMAND) and are billed monthly or as otherwise agreed.
7.2. You authorize Bernard Labs to charge your designated payment method for all subscription fees and applicable taxes.
7.3. Fees are non-refundable except as required by law or as explicitly stated in our refund policy.
7.4. We reserve the right to modify pricing with thirty (30) days' notice to active subscribers.
7.5. Failure to pay applicable fees may result in suspension or termination of your access to Bernard Labs.
8. Integrations and Third-Party Services
8.1. Bernard Labs may integrate with third-party services including FSM platforms, parts suppliers, and equipment manufacturers.
8.2. Your use of third-party integrations is subject to the terms and conditions of those third parties.
8.3. We are not responsible for the availability, accuracy, or functionality of third-party services.
9. Termination
9.1. We reserve the right to suspend or terminate your access to our services if you violate these Terms and Conditions or engage in fraudulent, abusive, or illegal activity.
9.2. You may cancel your subscription at any time through your account settings. Cancellation will be effective at the end of your current billing period.
9.3. Upon termination, your right to use the platform ceases immediately, though you may retain access to export your data for a limited period as specified in our data retention policy.
10. Changes to Terms
10.1. We may update these Terms and Conditions periodically. Any changes will be posted on this page with a new effective date.
10.2. For material changes, we will provide notice through email or platform notification at least thirty (30) days before the effective date.
10.3. Continued use of our services after changes become effective constitutes acceptance of the updated terms.
11. Indemnification
11.1. You agree to indemnify and hold harmless Bernard Labs, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the platform, violation of these terms, or violation of any rights of third parties.
12. Governing Law and Dispute Resolution
12.1. These terms are governed by the laws of the State of New York, United States, without regard to its conflict of law provisions.
12.2. Any disputes will be resolved in the state or federal courts located in New York County, New York.
12.3. You and Bernard Labs agree to first attempt to resolve any disputes through good faith negotiation before pursuing formal legal action.
13. Severability
13.1. If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
14. Entire Agreement
14.1. These Terms and Conditions, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Bernard Labs regarding the use of our services.
